Welcome to E-Sign Express! These Terms and Conditions govern your use of our electronic signature services, including our website, mobile app, and related features (collectively, the “Service”). 1. Eligibility and Account Responsibilities
You must be at least 18 years old to use the Service. When you sign up, you agree to:
- Provide accurate and complete information during registration.
- Keep your account credentials secure and not share them with others.
- Notify us immediately at support@esignexpress.com if you suspect unauthorized access to your account.
You are responsible for all activities under your account.
2. Use of the Service
E-Sign Express provides an electronic signature platform to facilitate document signing. You agree to:
- Use the Service only for lawful purposes and in compliance with applicable laws (e.g., eIDAS, ESIGN Act).
- Not upload or share content that is illegal, harmful, or violates the rights of others (e.g., copyrighted material, confidential information).
- Not attempt to hack, disrupt, or misuse the Service, including introducing viruses or malicious code.
3. Payment and Pricing
Our Service operates on a pay-as-you-go model:
- You are charged $1 per signature, with your first two documents free as part of our trial offer.
- Payments are processed securely via our third-party payment processor. You agree to provide valid payment information and authorize charges for signatures.
- All fees are non-refundable, except as required by law.
- We may update pricing with notice via email or on our website. Continued use after a price change constitutes acceptance of the new pricing.
4. Intellectual Property
E-Sign Express owns all rights to the Service, including its software, design, and branding. You retain ownership of the documents you upload, but grant us a limited license to process and store them as needed to provide the Service (e.g., facilitating signatures, maintaining audit trails). You are responsible for ensuring you have the right to upload and share any content.
5. Termination
You may stop using the Service at any time. We may suspend or terminate your account if:
- You violate these Terms.
- We suspect fraudulent or illegal activity.
- We discontinue the Service (with notice where possible).
Upon termination, your access to the Service will end, but we may retain certain data (e.g., audit trails) to comply with legal obligations.
6. Limitation of Liability
To the fullest extent permitted by law:
- E-Sign Express is not liable for indirect, incidental, or consequential damages (e.g., loss of profits, data loss) arising from your use of the Service.
- Our total liability for any claim is limited to the amount you paid us in the past 12 months.
- We do not guarantee that the Service will be error-free or uninterrupted, though we strive to provide reliable support.
7. Indemnification
You agree to indemnify and hold E-Sign Express harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, USA. Any disputes will be resolved through binding arbitration in Denver, Colorado, except for small claims, which may be filed in a local court.
9. Changes to These Terms
We may update these Terms to reflect changes in our Service or legal requirements. We will notify you of significant changes via email or a notice on our website. Your continued use of the Service after updates constitutes acceptance of the new Terms.
